This Privacy Policy is effective as of February 28, 2022. Effortless Home reserves the right to revise, amend, or modify this policy at any time and in any manner. When we change the policy in a material way a notice will be posted on our website along with the updated privacy policy. Your use of our website and any other services provided by us after such changes are implemented constitutes your acknowledgement and acceptance of these changes. Please consult this privacy statement prior to every use for any changes.  

Welcome to the Privacy Policy page of www.effortlesshome.com (the “Site”). This Privacy Policy is intended to enable visitors to the Site (“you”, “your”, or “viewer”) to learn about how Effortless Home collects and uses their personally identifiable information (“PII”).

This Privacy Policy supplements the Terms and Conditions and other Effortless Home notices, policies, and agreements, and is not intended to modify or supersede them. To the extent that there is a conflict between this Privacy Policy and any of the foregoing, but only to such extent, this Privacy Policy controls. 

What is PII?

PII is broadly defines and can include any data that can be used to identify a specific individual. Social Security numbers, mailing or email address, and phone numbers have most commonly been considered PII, but technology has expanded the scope of PII considerably. It can include an IP address, login IDs, social media posts, or digital images. Geolocation, biometric, and behavioral data can also be classified as PII.

Does Effortless Home require PII?

Effortless Home does not require you to provide us with any PII.  But in order to use certain functionality on the Site (for instance, to make submissions), to participate in events or promotions offered from time to time, or to use services made available exclusively through the Site, you will need to provide Effortless Home with certain PII.

What PII Does Effortless Home Collect?

We may collect, use, store and transfer different kinds of PII about you which we have grouped together as follows: (i) Identity Data includes first name, last name, username or similar identifier, and gender; (ii) Contact Data includes email address and delivery address; (iii) Usage Data includes information about how you use our Site, products and services; (iv) Technical Data includes your browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this Site; (vi) Marketing and Communications Data includes your preferences in receiving communications from us; (vii) Aggregated Data such as statistical or demographic data for any purpose. 

Aggregated Data may be derived from your PII but is not considered PII in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate Usage Data to calculate the percentage of users accessing a specific website or app feature. However, if we combine or connect Aggregated Data with your PII so that it can directly or indirectly identify you, we treat the combined data as PII which will be used in accordance with this Privacy Policy.

How Do We Collect PII and How is it Used?

  • You may give us your PII by filling in forms or by corresponding with us in person, phone, email or otherwise.

  • As you interact with our Site, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this PII by using cookies, and other similar technologies. We may also receive this type of information from service providers.

  • We may receive PII about you from various third parties such as those who link from their site(s) or services to us; from our vendors and promotional partners and others.

  • Effortless Home may use your PII for any of the following: (i) to perform the services or delivery the features offered to you on the Site; (ii) for our legitimate interests (or those of a third party); (iii) to comply with a legal or regulatory obligation; surveys; (iv) promotional offers; signups for future Effortless Home information or offerings; (v) to reveal general statistical information about our Site, such as number of visitors, pages viewed, etc.(such general statistical information shall not include your name or email address); or (vi) to keep records of services and features that are requested by you and/or delivered and/or received by you and our users, to study how customers use our products/services, to operate our business, to ensure that you are complying with our Terms and Conditions and this Privacy Policy, and to deliver information, products and services to our users that they will want or have requested.

  • Cookies are small text files that are placed in your computer’s browsers to store your preferences. Effortless Home’s cookies do not contain any PII. However, they may reference PII you have provided on other pages of Effortless Home’s Site (such as during registration) using an encrypted identifier. When these unique identifiers are linked with your PII, and for the duration that they are linked, they will be treated as PII by Effortless Home. Both session ID cookies and persistent cookies are used on Effortless Home’s Site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. Note, if you disable or refuse cookies, some parts of this website may become inaccessible or not function properly.

  • We gather certain information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole. We will not use the information collected to market directly to that person.

  • In some of our email messages, we may use a “click-through URL” linked to content on our website. When customers click one of these URLs, they pass through our web server before arriving at the destination web page. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked simply avoid clicking text or graphic links in the email.

  • Additionally, we may use pixel tags (clear GIFs)—tiny graphic images—to tell us what parts of our website customers have visited or to measure the effectiveness of searches customers perform on our Site. Pixel tags also enable us to send HTML email messages in a format customers can read and they tell us whether emails have been opened to ensure that we’re sending only messages that are of interest to our customers. We may use this information to reduce or eliminate messages sent to a customer. We store all of this information in a secure database located in the United States.

Effortless Home may use your PII to help us cater to your specific wants and needs. Your PII helps us determine which services and products are relevant to you. If you have requested information from us, you may receive communications in response to your request as well as certain promotional offers.

How Effortless Home Uses Your PII with Third Parties

Effortless Home does not and will not sell or rent your PII to any organization.

Effortless Home will keep your name and email address strictly confidential.

Effortless Home’s websites or mobile application (if applicable) may contain links to other websites. You acknowledge and agree that Effortless Home is not responsible for the privacy practices or the content of such websites. For further information, please review the privacy policies of such third-party websites.

Disclosures of Your Personal Data

We may have to share your PII with certain parties below below in conjunction with the above. Effortless Home requires that the third parties below treat your PII in strict accordance with all applicable Law governing such PII, and not to share your PII with any other parties.

  • To the extent that some of our external third parties are based outside the European Economic Area (EEA) and you are a European national, we will ensure, as commercially reasonable, that your PII is safeguarded by (where applicable): (i) transferring your PII only to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission; using specific contracts, which may have been approved by the European Commission, that give PII the same protection it has in Europe; and transferring data to third-parties that are part of the Privacy Shield which requires them to provide similar protection to PII shared between the Europe and the US.

PII Security

Effortless Home shall employ commercially reasonable security measures to prevent your PII from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. 

PII Retention

Effortless Home will only retain your PII for as long as necessary to fulfill the purposes expressly stated herein.

Legal 

In certain jurisdictions and under certain circumstances, you may have the right to: (i) receive a copy of the PII we hold about you and to check that we are lawfully processing it; (ii) request a correction of your PII; (iii) request erasure of your PII us to delete or remove personal data where there is no good reason for us continuing to process it; (iv) object to the processing of your PII for certain purposes; and (v) request that we suspend or discontinue processing your PII.

Notice of Compliance to California Residents 

California law requires that we provide you with a summary of your privacy rights under the California Online Privacy Protection Act (“California Act”) and the California Business and Professions Code. As required by the California Act, this privacy policy identifies the categories of personally identifiable information that we collect through our website about individual consumers who use or visit our website and the categories of third-party persons or entities with whom such personally identifiable information may be shared. 

Depending on the visitor’s activity on our Site, certain “personally identifiable information” (as that term is defined in the California Act) may be collected, in addition to information set forth in other sections of this document. Request for Information
You may request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Upon receiving and confirming your verifiable consumer request, we will disclose the following information to you: (1) Our business or commercial purpose for collecting your personal information. (2) The categories of personal information we collected about you. (3) The categories of sources for the personal information we collected about you. (4) The categories of third parties with whom we share that personal information. (5) The specific pieces of personal information we collected about you.

Further, you may request that we delete any personal information of your that we collected and retained, subject to certain exceptions. Upon receiving and confirming your verifiable consumer request, we will delete your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to: (1) Complete the transaction that contains your personal information, (2) Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities. (3) Debug products that impair functionality. (4) Exercise our First Amendment rights. (5) Facilitate internal uses that reasonably align with our consumer’s expectations. (6) Comply with applicable law. (7Perfirm internal and lawful uses of the information.

If you wish to opt-out or exercise any of the other rights listed above, please submit a verifiable consumer request to us by either:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must (i) provide sufficient information to allow us to reasonably verify that you are the person about whom we collected personal information; and (2) describe your request with sufficient detail us to allow us to properly respond and process your request.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.
We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format
We will make our best effort to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding our receipt of the verifiable consumer request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination
We will not discriminate against you for exercising any of your rights under the Act.

EU Residents
We will only retain your personally identifiable information (“PII”) for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting or reporting requirements. To determine the appropriate retention period for PII, we consider the amount, nature, and sensitivity of the PII, the potential risk of harm from unauthorized use or disclosure of your PII, the purposes for which we process your PII and whether we can achieve those purposes through other means, and the applicable legal requirements. 

It is important that the PII we hold about you is accurate and current. Please keep us informed if your PII changes during your working relationship with us.  

Your rights as a data subject

Under certain circumstances, by law, you have the right to:

Request access to your PII (commonly known as a "data subject access request"). This enables you to receive a copy of the PII we hold about you and to check that we are lawfully processing it.

Request correction of the PII that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.

Request erasure of your PII. This enables you to ask us to delete or remove PII where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your PII where you have exercised your right to object to processing.

Object to the processing of your PII where we are relying on a legitimate interest (or those of a third party), and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your PII for direct marketing purposes.

Request the restriction of processing of your PII. This enables you to ask us to suspend the processing of PII about you, for example, if you want us to establish its accuracy or the reason for processing it.

Request the transfer of your PII to another party.

Your right to withdraw consent

In circumstances where you may have provided your consent to the collection, processing, and transfer of your PII for a specific purpose, you have the right to withdraw your consent for that specific processing at any time.  You have the right to withdraw consent to marketing by following the opt-out links on any marketing message. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so in law.
